Freight Forwarder Liability Insurance

Every freight forwarder is required to hold a Freight Forwarder Liability Insurance (SHP) for conducting their business under the applicable ADSp terms and conditions, as well as a Freight Forwarder General Policy (SGP) to provide cargo transport insurance for their clients.

Individual liability agreements, general terms and conditions, and all types of foreign liability frameworks such as NSAB, Fenex or AÖSp can also be covered under the freight forwarder liability policy. In addition, ancillary logistics services carried out at your warehouse, such as picking, packing or processing of goods, can be included in the coverage.

Without a freight forwarder liability insurance concluded in accordance with the ADSp, the freight forwarder is not entitled to refer clients to the ADSp liability provisions.

Carrier Liability / CMR Insurance

Anyone operating commercial road haulage in Germany is required by law to take out carrier liability insurance. The minimum insured sum is 1.25 million EUR and covers domestic transport in accordance with § 7a GüKG/HGB. This applies regardless of whether the carrier is based in Germany or abroad.
Coverage for international cross-border transport can be arranged through a CMR insurance policy.
Damage to Third-Party Trailers
The liability policy can also cover damage to third-party trailers. Carriers are often provided with trailers and similar equipment by their clients for the transport of goods – whether free of charge or for a fee. These form part of the transport contract, meaning the carrier is liable in the event of damage or total loss. All types of trailers can be insured.

Cargo Transport Insurance

Under cargo transport insurance, goods of all kinds can be insured for transport by air, land or sea. It covers damage to the goods occurring during the insured transport up to the declared insured sum. Cargo transport insurance offers significantly greater security for the client. An additional 110% coverage for freight costs and similar expenses can also be included.

In addition to faster claims processing, it does not rely on the statutory, contractual or weight-based liability limitations of carriers, and also covers damage that the freight forwarder or carrier would not be required to compensate under statutory liability. Coverage is recommended for almost all goods and transport types.

Thanks to cargo transport insurance and the “financial loss clause”, financial losses resulting from delivery deadline overruns can also be included in the insurance contract.

A Transport General Policy (TGP) is particularly recommended for shippers with continuous goods dispatch. It enables flexible and permanent coverage of all transports under a single central contract.

Please also refer to ADSp 2017, Section 21, Insurance of Goods, which states, among other things: "The freight forwarder shall arrange insurance of the goods where this is in the interest of the client."

Scope of coverage at a glance

Trailer/Chassis Insurance

Own and third-party trailers, chassis, swap bodies and similar equipment can be protected against damage through a comprehensive insurance policy. The scope of coverage is nearly identical to that of a fully comprehensive motor vehicle insurance, covering risks such as theft, damage, vandalism, fire and the classic accident.

Hook Load Insurance

Hook load insurance covers towing, recovery and crane operation assignments carried out with vehicles from your own fleet.

It provides liability coverage for damage to or destruction of goods caused by the breaking of hooks on cranes, tow trucks and similar equipment — regardless of whether any fault on the part of the owner or operator can be established.

Hook load insurance is a must for anyone who operates crane attachments on their trucks, carries out crane work, or is active in the recovery and towing sector. Coverage for general terms and conditions as well as the AGB-BSK can also be included.
